Welcome to Surfing Sobriety™ ("Surfing Sobriety", "we", "our", or "us").
These Terms of Use ("Terms") govern your access to and use of the Surfing Sobriety mobile application, website, content, tools, resources, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to these Terms.
If you do not agree with these Terms, please do not use the Service.
1. Purpose of the Service
Surfing Sobriety provides educational resources, self-help tools, wellbeing resources, and recovery support materials intended to help users build awareness, develop healthy habits, and navigate challenges associated with recovery and personal growth.
The Service may include features such as:
Sobriety tracking
Goal setting
Reflection and journaling tools
Financial savings tracking
Vision boards
Mindfulness exercises
Breathwork resources
Somatic practices
Educational content
Recovery-focused resources
Community features (where available)
The Service is designed to complement—not replace—professional care.
2. Important Health Disclaimer
Surfing Sobriety is a support tool.
Surfing Sobriety is not:
A medical service
A healthcare provider
A rehabilitation facility
A crisis service
A substitute for professional treatment
A substitute for medical advice, diagnosis, or therapy
Nothing within the Service should be interpreted as medical, psychological, psychiatric, therapeutic, legal, financial, or professional advice.
Always seek advice from appropriately qualified professionals regarding your circumstances.
3. Emergency and Crisis Situations
Surfing Sobriety is not monitored 24 hours a day and cannot provide emergency assistance.
If you are experiencing:
A medical emergency
Severe withdrawal symptoms
Suicidal thoughts
Thoughts of self-harm
Thoughts of harming another person
A mental health crisis
Any situation requiring urgent assistance
contact emergency services or an appropriate crisis support service immediately.
In Australia, call 000.
Do not rely on Surfing Sobriety during an emergency.
4. No Professional Relationship
Use of the Service does not create a therapist-client, psychologist-client, doctor-patient, counsellor-client, sponsor-sponsee, coaching, fiduciary, or other professional relationship between Surfing Sobriety and any user.
5. Eligibility
You must be at least 18 years old to use the Service.
By using the Service, you confirm that:
You are at least 18 years old;
You have the legal capacity to enter into these Terms; and
You will use the Service lawfully.
6. Recovery Is Not Linear
Recovery experiences vary from person to person and may include relapses, setbacks, and periods of renewed substance use.
Surfing Sobriety is intended to support users without judgment throughout their recovery journey.
A relapse, or return to use does not constitute a failure of the Service and does not create any entitlement to compensation, refund, or claim against Surfing Sobriety.
7. No Guarantee of Results
Recovery outcomes differ significantly between individuals.
We do not guarantee:
Sobriety
Abstinence
Reduced substance use
Reduced cravings
Improved mental health
Improved physical health
Prevention of relapse
Any specific outcome
Any examples, testimonials, educational materials, or user stories are provided for informational purposes only and do not guarantee similar results.
8. Withdrawal and Medical Safety
Users are responsible for obtaining appropriate medical advice before reducing, ceasing, or changing the use of alcohol, medications, or other substances.
Certain forms of withdrawal may be dangerous or life-threatening and may require medical supervision.
Always consult qualified professionals before making decisions regarding:
Detoxification
Medication
Mental health treatment
Physical health treatment
Rehabilitation programs
Exercise programs
Dietary changes
9. User Responsibility
You remain solely responsible for:
Your decisions
Your behaviour
Your recovery plan
Your treatment choices
Any actions taken based on information provided through the Service
You acknowledge that recovery may involve multiple forms of support, including healthcare professionals, counsellors, psychologists, psychiatrists, peer support groups, rehabilitation services, family members, and community resources.
10. User Accounts
You are responsible for maintaining the confidentiality of your account credentials.
You agree to:
Provide accurate information;
Keep your login information secure;
Notify us of any unauthorised use of your account.
You are responsible for activity occurring under your account.
11. User Content
You may submit content through the Service, including:
Journal entries
Reflections
Goals
Vision board content
Uploaded images
Support contacts
Other information entered into app features
You retain ownership of your content.
By submitting content, you grant Surfing Sobriety a limited licence to store, process, display, and transmit that content solely for the purpose of operating the Service and providing app functionality.
You must not upload content that:
Is unlawful
Infringes another person's rights
Contains malicious software
Harasses, threatens, or abuses others
Is fraudulent or deceptive
We reserve the right to remove content that violates these Terms.
12. Community Features
Any community features provided through the Service are intended for peer support and discussion only.
Users must not use community spaces to:
Provide medical advice
Encourage substance use
Promote illegal activity
Harass or intimidate others
Engage in conduct that may place another person's wellbeing at risk
We reserve the right to remove content or restrict access where necessary to protect users and the integrity of the Service.
13. Subscriptions and Payments
Access to Surfing Sobriety requires an active subscription following any applicable free trial period.
Surfing Sobriety currently offers:
A 7-day free trial
A recurring monthly subscription
Subscription pricing is displayed at the time of purchase.
Subscriptions are processed through:
Apple App Store
Google Play Store
Billing, renewals, cancellations, and refunds are generally governed by the policies of the platform through which the subscription was purchased.
Deleting your Surfing Sobriety account does not automatically cancel your subscription.
Users are responsible for managing subscriptions through their Apple App Store or Google Play account.
Additional products, services, memberships, communities, courses, events, or digital offerings may be offered separately in the future and may be subject to their own pricing, terms, and conditions.
14. Third-Party Services and Content
The Service may provide access to third-party services, resources, videos, podcasts, websites, educational materials, and support services.
The inclusion of third-party resources does not constitute endorsement.
Surfing Sobriety is not responsible for the accuracy, availability, effectiveness, safety, or content of third-party services or materials.
Use of third-party resources is at your own discretion.
15. Intellectual Property
The Service and its contents, including branding, logos, graphics, software, text, design elements, and educational materials, are owned by or licensed to Surfing Sobriety and protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, reverse engineer, sell, or commercially exploit any part of the Service without written permission.
16. Service Availability
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free access.
The Service may be modified, updated, suspended, interrupted, or discontinued at any time.
We are not liable for outages, interruptions, delays, technical failures, or loss of data.
Users are encouraged to maintain their own copies of important information.
17. Limitation of Liability
To the maximum extent permitted by law, Surfing Sobriety and its owners, employees, contractors, affiliates, licensors, and service providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from:
Use of the Service
Inability to use the Service
Reliance on information provided through the Service
Recovery outcomes
Relapse events
Medical decisions
Treatment decisions
Loss of data
Loss of profits
Personal injury
Emotional distress
Where liability cannot be excluded by law, our liability is limited to the minimum extent permitted by law.
18. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law or other applicable legislation.
Where permitted by law, our liability for any breach of a non-excludable guarantee is limited to:
Re-supplying the relevant services; or
Paying the cost of having the services supplied again.
19. Indemnity
You agree to indemnify and hold harmless Surfing Sobriety, its owners, contractors, employees, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from:
Your misuse of the Service;
Your breach of these Terms;
Your violation of any law; or
Your infringement of another person's rights.
20. International Users
Australian Users: These Terms are governed by the laws of Queensland, Australia and the Australian Consumer Law.
European Union Users: If you are located in the European Union, you have additional rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, restrict, port, and object to processing of your personal data. To exercise these rights, contact us at info@surfingsobriety.com. We do not sell personal data. Where we transfer data outside the EU, we apply appropriate safeguards consistent with GDPR requirements.
California Users: If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to request deletion, and the right to opt out of sale of personal information. Surfing Sobriety does not sell personal information. To exercise your rights, contact info@surfingsobriety.com.
All International Users: Regardless of your location, we handle your personal information in accordance with our Privacy Policy and applicable law.
21. Termination
We may suspend or terminate access to the Service if:
These Terms are breached;
Illegal activity is suspected; or
Continued access presents a risk to users or the Service.
You may stop using the Service at any time.
Termination does not affect rights or obligations that arose before termination.
Your use of the Service is also governed by our Privacy Policy.
Please review the Privacy Policy carefully to understand how personal information is collected, stored, used, and protected.
23. Changes to These Terms
We may update these Terms from time to time.
Updated Terms will be published within the Service or on our website and become effective upon publication unless otherwise stated.
Continued use of the Service constitutes acceptance of revised Terms.
24. Governing Law
These Terms are governed by the laws of Queensland, Australia.
Before commencing any legal proceedings, the parties agree to attempt to resolve any dispute through good faith negotiation for a period of at least 30 days from written notice of the dispute.
If the dispute is not resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
